Filing a WSIB Claim

The Workplace Safety & Insurance Act (WSIA) states that an injury must be reported within six months of the injury or within six months of a diagnosis to claim benefits.

The best way to increase your chances of WSIB coverage, is to report the injury right away. Additionally, you should also seek medical treatment as soon as possible to ensure there is a record of the event by a treating physician. The WSIB will notify you whether or not your claim has been approved. You should report and keep a written record of the incident even if you are advised by your employer not to make a report. This can help avoid potential issues later on if your employer ends up giving you a hard time, or your injury worsens. 

Form 6

On the Form 6, you should provide as much details as you can about your injury. You should include the cause of your injury, the location, names of any witnesses, and what area of your boy you injured. 

 

The more details you are able to provide, the more the WSIB is able to look into or corroborate your story with the employer and/or witnesses. 

It is also important to list all areas of your body that was injured. If you only list the most injured area, and after a while another area starts hurting more, the WSIB may deny the other areas of injury. It is important to have a written record of all areas of injury, and the progress or decline of those injuries. If the WSIB denies any of these areas, the written record will provide more evidence for any potential appeals.
